When there is a valid reason to challenge a will, I represent family members and friends of the deceased in will contest suits. Common reasons wills are contested include:

  • The testator lacked testamentary capacity — commonly argued in cases of dementia or insanity
  • The testator was under the influence of drugs or alcohol
  • The will is fraudulent or was forged
  • The testator was being unduly influenced when writing the will
  • A new will pre-empts the will being probated
  • The will was improperly executed — usually due to improper witnesses or if the will is unsigned
  • The will is ambiguous and requires court interpretation

Many wills contain a “no contest” clause. In these situations, heirs who contest their share under a will risk forfeiting all benefits if the will is upheld. I work closely with individuals to carefully evaluate the circumstances surrounding the will’s execution and examine additional evidence to ensure their claim is valid before bringing a will contest suit.
